This BOLT Data Protection Notice (“Notice”) describes how Kooperasi Bersatu Tenaga Malaysia (“KOBETA”) and/or Beta Lab Sdn Bhd (“Beta Lab”) either itself or through a third party engaged by Beta Lab which may include any service provider, uses your Personal Data.

KOBETA and/or Beta Lab shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on the BOLT mobile application (“App”). By continuing to communicate with KOBETA and/or Beta Lab or use KOBETA services following the modifications, updates or amendments to this Notice, such actions shall signify your acceptance of such modifications, updates or amendments.

Collection of Personal Data

1. “Personal Data” means information about you, from which you are identifiable, including but not limited to your name, identification card number, passport or other identification number (where applicable), phone numbers (mobile, residential, workplace), residential address, workplace address, e-mail address, age or date of birth, race, marital status, name of spouse or child or family members, photograph, video image or voice/video recording, signature, occupation, salutation, bank account number(s), credit card details, the festivals you celebrate, your household income, household size, personal product preferences, preferred language, information you would like to receive, any information about you which you have provided to KOBETA and/or Beta Lab in any correspondence or through the use of BOLT or third party App and social media pages, from cookies, pixel tags, web beacons, IP addresses, type of browser, type of operating system, the name of your internet service provider, domains used by your service providers, mobile network, device identifiers, device settings, browser settings, type of mobile device, location information, content and advertisement accessed by you and navigational data, data provided to KOBETA and/or Beta Lab through its customer service channels, surveys and/or any information about you that has been or may be directly or indirectly collected, stored, used and processed by KOBETA and/or Beta Lab from time to time. If you do not wish to have cookies placed on your mobile device while browsing the App, please set your browsers to refuse cookies before using the App, with the drawback that certain features of the App may not function properly without the aid of cookies.
2. The provision of certain Personal Data is mandatory in certain circumstances and if you do not provide such Personal Data, KOBETA and/or Beta Lab will not be able to provide you the services you have requested. In most circumstances, the provision of your Personal Data is voluntary but if you do not provide KOBETA and/or Beta Lab with your Personal Data, KOBETA and/or Beta Lab may not be able to provide the products or services you have requested or attend to your request in an efficient manner and you may not be able to enjoy the benefit of offers and promotions by KOBETA.
   

   Sourses of Personal Data

3. In addition to the Personal Data you provide to KOBETA and/or Beta Lab directly, KOBETA and/or Beta Lab may also collect your Personal Data from a variety of sources, and in various ways such as:-
   
   • Through your access and use of the App, social media pages and other online and telephone services, including the customer call centre;
   • Through your employer including the data stored by your employer’s Human Resources Department;
   • During interactions and communications between individuals or their representatives and KOBETA and/or Beta Lab representatives and/or third parties;
   • When you complete an application form, enquiry form, questionnaire, competition or survey or any other forms;
   • When you provide feedback regarding KOBETA services or App;
   • When you participate in KOBETA offers and promotions;
   • Credit bureau reports and credit reporting agencies to indicate your credit worthiness;
   • Governmental agencies, regulatory and statutory authorities;
   • Publicly available sources and from third
     

     Purposes of Processing

4. KOBETA and/or Beta Lab may use and process your Personal Data to provide you the products and/or services you have requested, to perform the contract you have entered into with your employer, to perform the contact we have entered into with your employer, to perform the contract you have entered into with any service providers via our App and for the purposes relating to the business and activities of KOBETA which shall include, without limitation the following (“the Purposes”):
   
   • to process, confirm and fulfill your requests regarding KOBETA services or transactions;
   • to facilitate the processing of your salary advance request submitted via the App;
   • to facilitate the process of depositing the sum requested in your salary advance request with the relevant financial institution;
   • to facilitate the process of deducting the sum requested with applicable service charges from your monthly salary with your employer for repayment of the sum requested;
   • to contact you regarding your enquiries and requests;
   • for user identification for login to the App, portals and other online services provided by or on behalf of KOBETA;
   • to ensure that the content is presented in the most effective manner for the device used;
   • to comply with or to enforce the terms and conditions of any contract or agreement entered into by or on behalf of KOBETA to which KOBETA is otherwise bound or is obliged to observe;
   • to process payment, salary deduction and repayment transactions;
   • to conduct research, survey and analysis;
   • for internal administrative and technical support purposes;
   • for internal and external investigations;
   • for purposes of detection, prevention and prosecution of crime;
   • to conduct audit and investigations, and manage risks and crises;
   • to enforce or defend KOBETA and/or Beta Lab or its affiliates’ legal rights, interests or property and/or to obtain legal advice;
   • for KOBETA and/or Beta Lab to comply with its obligations under law whether within or outside Malaysia;

     and you agree and consent to Beta Lab using and processing your Personal Data in the manner as identified in this Notice.

     Marketing and Promotional Purposes

5. Unless you have indicated otherwise, KOBETA and/or Beta Lab may also use and process your Personal Data for marketing and advertising purposes such as to send you communication regarding KOBETA latest offers, promotions, events, products or services such as newsletters or flyers by way of e-mail, post, phone calls, social media platforms and any other mode of communications (“Marketing Purposes”).

   If you do not consent to KOBETA and/or Beta Lab processing your Personal Data for the Marketing Purposes, please contact our Customer Service representative contact details of which are as provided in Clause 9 below.

   Disclosure and Tranfer of Personal Data

6. and you understand and consent to the transfer of your Personal Data out of Malaysia as described herein.Your Personal Data may be transferred to, stored, used and processed in a jurisdiction other than Malaysia, such as in the following circumstances:

   • Where KOBETA and/or Beta Lab administrative functions are being performed outside of Malaysia;
   • where KOBETA and/or Beta Lab or its service providers’ servers or back-up servers are located outside of Malaysia;
   • where personal information is required to be disclosed to various law enforcement agencies outside of Malaysia;
   • where KOBETA and/or Beta Lab service providers, contractors, agents or partners are located outside of Malaysia;

     and you understand and consent to the transfer of your Personal Data out of Malaysia as described herein

7. Your Personal Data may be transferred, accessed or disclosed to third parties for the Purposes or for Marketing Purposes. Further, KOBETA and/or Beta Lab may engage other companies, service providers or individuals to perform functions on KOBETA and/or Beta Lab’s behalf, and consequently may provide access to or disclose your Personal Data to such service providers or third The third parties referred to in this section include (without limitation):

   • KOBETA and/or Beta Lab’s professional advisors, including legal advisors, auditors, accountants and consultants;
   • service providers such as KOBETA and/or Beta Lab’s information technology (IT) service provider;
   • KOBETA and/or Beta Lab’s social media agency; and
   • regulatory and governmental authorities within and outside Malaysia, in order to comply with statutory and government requirements.

     Your Personal Data may also be shared in connection with a corporate transaction involving KOBETA and/or Beta Lab, such as a sale of a subsidiary or a division, merger, consolidation, or asset sale, or in the unlikely event of winding-up.

     Personal Information from Minors and Other Individuals 

8. As a parent or legal guardian, please do not allow the minor (individuals under 18 years of age) under your care to submit Personal Data to KOBETA and/or Beta Lab. In the event that such Personal Data is provided to KOBETA and/or Beta Lab, you hereby consent to the processing of the minor’s Personal Data as his/her parent or legal guardian and personally accept and agree to be bound by this Notice and take responsibility for his or her actions.

Please note that if you withdraw your consent for KOBETA and/or Beta Lab to process your Personal Data for the Purposes or for Marketing Purposes, KOBETA and/or Beta Lab may consequently not be able to transact with you and may be unable to provide you the products or services which you have requested.
11. In respect of your right to access and/or correct your Personal Data, KOBETA and/or Beta Lab has the right to refuse your requests for reasons permitted under law, such as where KOBETA and/or Beta Lab is not supplied with such information as is reasonably required to locate the Personal Data to which the data access request relates or ascertain in what way the Personal Data to which the data correction request relates is incorrect.

12. By communicating or engaging with KOBETA and/or Beta Lab, or using KOBETA and/or Beta Lab services, you acknowledge that you have read and understood this Notice and agree and consent to the use, processing and transfer of your Personal Data by KOBETA and/or Beta Lab as described in this Notice.
